Terms of sale

Last updated: [DATE]

The short version

1. Who we are

Somewhere Held is a trading name of LIMITLOCK LIMITED, a company registered in Ireland under company number 793491. Our registered office is Dublin, Ireland. [VAT number: VAT NUMBER, or delete if not VAT-registered].

You can contact us through our contact page or by post at the address above.

These terms apply when you buy from us as a consumer, meaning for purposes mainly outside your trade, business or profession. [If business orders are accepted, add separate business terms.]

2. Your design and our products

You design your relief map in your browser: you choose a place, the area, the size, colours, frame and any routes, symbols, names, dates or inscription. We then have the model 3D-printed by a production partner and sent to you.

Please keep in mind:

3. Checking your design

Before you pay, we show you a summary of your design. Please check the spelling of names and inscriptions, dates, the place, the map area and any route. We will produce the design exactly as you approve it, so a mistake in what you entered is not a fault in the product.

The content you add must be yours to use. Please do not include anything unlawful, offensive or that infringes someone else's rights. We may decline or cancel an order, with a full refund, if we reasonably believe it does.

4. Placing an order and when the contract starts

When you place an order, you are offering to buy. We will email you to acknowledge it. The contract between us begins when we send you an email confirming that we have accepted your order [or: when payment is taken; owner to decide].

If we cannot accept your order, for example because the design cannot be printed reliably, an item is unavailable or there is an obvious pricing error, we will tell you and will not charge you (or will refund you in full).

5. Prices, VAT and payment

Orders outside the UK

[Choose one:] [A] Prices for EU and US delivery include import VAT and customs duties, so there is nothing further to pay on delivery. [B] Orders shipped outside the UK may be charged import VAT, customs duties, sales tax or handling fees by the destination country or courier. These are payable by you and are not included in our price.

6. Production and delivery

7. Ownership and risk

The map is your responsibility from the time it is delivered to you or to someone you nominate to receive it. It becomes yours once we have received full payment.

8. Cancelling your order

When you buy online you usually have 14 days to change your mind. This right does not apply to goods made to the consumer's specifications or clearly personalised (regulation 28(1)(b) of the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, and the equivalent rule in Article 16(c) of EU Directive 2011/83/EU). Every map we sell is made to your design, so you cannot cancel for a change of mind.

[Optional goodwill policy, owner to decide:] If you contact us within [X hours] of ordering and before your design has gone into production, we will try to cancel it and give you a full refund. Once production has started we cannot do this.

This does not affect your rights if the map is faulty or not as described (see section 9).

9. If something is wrong

We must provide goods that are of satisfactory quality, fit for purpose and as described. Under the Consumer Rights Act 2015, if your map is faulty or not as described:

If you live in the EU, you also have the legal guarantee of conformity under the law of your country, which lasts at least two years from delivery.

See our returns and refunds page for how to tell us about a problem. If we need the item back, we will pay the reasonable cost of returning it.

10. Refunds

We refund to the payment method you used, within 14 days of agreeing that you are entitled to a refund. If you reject a faulty map within the first 30 days, the refund includes the original delivery charge.

11. Our liability to you

12. Intellectual property and map data

The design of this website and our studio software belong to us or our licensors. Maps are produced from open data: map data © OpenStreetMap contributors, available under the Open Database Licence. Buying a map gives you the physical object; it does not transfer rights in the underlying data or our software.

You keep any rights in the text you add. You allow us to use it only as far as we need to make and deliver your order. [If you want to show customer designs in marketing, ask for separate permission.]

13. Complaints and disputes

If you are unhappy, please contact us first through our contact page. We aim to reply within [X] working days.

[If you join an alternative dispute resolution (ADR) scheme, name it here. Otherwise:] We are not currently a member of an alternative dispute resolution scheme. If you live in Ireland, the Competition and Consumer Protection Commission (ccpc.ie) offers free information. Elsewhere in the EU, your national European Consumer Centre may be able to help; in the UK, Citizens Advice.

14. Law and courts

These terms are governed by the law of Ireland, and you can bring legal proceedings in the Irish courts. If you live elsewhere in the EU or in the UK, you keep the protection of the mandatory consumer laws of the country where you live and may bring proceedings there.
